I am wondering what role the federal Privacy Act plays in any of this. HIPAA, which specifically addresses medical information and records was discussed, but not the Privacy Act. When I was a federal employee, all of us were required to comply with the Privacy Act, and there were penalties for noncompliance, potentially including jail time and fines. This meant that we were required to purge all records we had collected, say, in a lawsuit, of all “personally identifiable information” (PPI) after the conclusion of the matter for which it had been collected (e.g., a lawsuit). Under the Privacy Act, PPI included social security numbers, dates of birth, home addresses, medical and tax records and even names. We were provided shredders for the purpose of complying and were also required to purge electronic records containing PPI. It would be helpful to have the authors of this informative piece weigh in on the application of the Privacy Act to the actions and proposed actions of the government to the matters discussed. Trump has existed all his life in a law-free world. He has never experienced any personal legal repercussions for any of his actions. His minions seem to think they’re equally impervious to the law, if they even know what it is. I suspect the latter — they’ve never seen it as relevant.
